Visa Grant Delay 189

Hi Friends - not sure how the below post will be helpful or make / does not make any sense ; but would like to share my own experience -

My partner called immigration help desk today

mentioned that we lodged 189 visa application in March 2019 , initially it showed 8 - 9 months, now 11 - 22 months. What’s happening ? also mentioned that after going through forums / few predictions here and there, got to know there is an indefinite delay in 189 processing. also requested him like what could be the reasons behind all these and by when likely we may get grant.

Below is the response from help desk member -

Nothing is official until we confirm the actual reasons ; Times do vary and there is no definite control over it It depends on no of applications received Vs no of back logs Nothing to do with Regional / non regional visa thing - every visa got its significance and hence forth invitations are being sent One interesting fact which they told was - CO will be hired on contract basis and currently they are falling short of COs considering back log clearance related pressure from Govt finally they said that dont worry about not receiving grant at all - You will receive your grant as long as you are genuine; Worst thing which may happen is it may take more time than expected which is current scenario They also asked my partner if we are living offshore / onshore - My partner mentioned Onshore - Then they said - why do you even bother since you have a valid visa to live indefinitely and work indefinitely (Bridging visa) We also asked whether we need to re-do assessments and Police / medical checks due to these delays - They politely refused this question and said its up to CO

Somehow we felt like we received default answers :slight_smile: as usual…

But the bottom line again - We are not criminals, we are professionals and genuine which implies we will get GRANT on “THE DAY” - but little / too late - Thats it

I think one thing is misunderstood here as far as processing time is concerned. It is not the average of the processing time. It is the time taken to process the worst case in 75% and 90% of the application processed. Also, this is not grant but process, which means it can also include rejection. So for example, if there are 100 applications processed in a month and sorted from fastest to the slowest, then 11-22 months would mean that the 75th application took 11 months to process and 90th application took 22 months to complete the processing. So even in case the 74 applications took 3 months to complete, and 75th took 11 months, it will show 75% completed in 11 months. I hope this clears the doubt.

Thanks for detailed info., Yes it is helpful because they said they are short of COs and they are hiring people, i think this is great information which they shared which i called something internal they shared…and yes we are professionals and we will get what we are supposed to…thanks kee posting and keep sharing…i am thinking to call them on 8th Nov. When it will be 11 months to my application…

Hi I slightly disagreed with you here, maybe I am wrong. Quoting from the Immi website, “Global visa processing times will be updated monthly, providing you with an indicative timeframe for processing applications … … Two processing times are displayed in calendar days, indicating how long it is taking to finalise 75 and 90 per cent of applications submitted globally.” When it is a matter of per cent, it is an average, that’s what my understanding is.

Thanks for sharing the information, however, in my case I have got Bridging Visa but since I am on 457 temporary work visa that has work restrictions I can not work for any other employer apart for my present employer, I have already lost lot of opportunities.

My friend -

My case is also absolutely similar.

  1. I started working in Aus from Oct 2015 (on deputation) for Employer based in India on 457 Visa
  2. My 457 Visa was due expiry on July 23rd 2019
  3. I luckily got invite in March 2019 , submitted Visa application in March 2019 - The momement i submitted Visa, bridging Visa was issued but inactive
  4. My 457 Visa got expired on July 23rd 2019
  5. My bridging visa got automatically activated on July 24th, 2019
  6. My employer absolutely had no issue in me continuing on bridging Visa for same client , same location
  7. I started job search in parallel from July 1st, got offer on July 15th and my joining date for new employer was August 26th
  8. My new employer did perform all required background checks and most importantly - VEVO check to see if i am eligible to work or not
  9. My new employer then updated they absolutely had no issue in me joining a job on bridging visa since there are 2 clauses clearly indicated in my Visa a) Can live indefinitely in Australia b) Can work indefinitely in Australia - no conditions apply

That’s good that your current employer didn’t have any issue in continuing with the same client. A lot of IT companies don’t allow people to work on bridging visa. In my case my temporary work visa is getting expired on 10th Feb 2021, until then my bridging visa won’t be active. I hope my bridging visa will have also no condition applied once my temp visa is expired, and we all know how these Indian IT companies work it’s an extremely volatile situation for me. I guess I have to keep on watching Shawshank Redemption on loop :slight_smile:

Good luck to all of us! Just another question, does anybody know if bridging visa combined with a PR partner can apply for home loan or not? Cheers

As per my understanding - Absolute “NO” If you are on bridging Visa, you don’t even get a Credit Card / Personal loan most cases.

And to my worse, I was denied for a sim card (Optus) as they mentioned Customer credit check failed due to invalid Visa category

If your partner is on PR, and if she will be the primary applicant, “YES” more likely chances of getting a home loan ; but definitely not with you as a primary applicant

Thanks @Ram_Kashyap for letting us know about your conversation with the immigration help desk. For us living overseas, it helps a lot since calling them from overseas is expensive and sometimes they don’t pick up calls till your credits done. It seems that the reason for the change is “confidential” but the thing is, we-the professionals who already invested so much are the sole and directly impacted with the decisions.

It may seem heavy to carry, so i encourage everyone to take it lightly since we don’t have control over it.

Hi… I and my wife lodged visa on July 19 under 189 subclass. I got a lot of family pressure to plan a family. I need guidance if we plan baby in India then what will be the complications related to visa lodgement. Can a baby be added later under PR. I am not sure if I can wait till 22 months and plan in Australia…!!

Hi All, I have submitted my application on 25th July 2019 with “Software Engineer - ANZSCO 261313” for 2 members(me and my husband). Will all the applications take 11-22 months processing time? I am able to see “global processing time” as 11-22 months which was previously I guess 7-9 months.

Unfortunately the most precise answer would be that nobody really knows how long. Even the department. The processing time could change again
