Recent post-Budget-2020 news is really daunting. E.g., this https://www.emergico.com.au/news/australias-migration-program-2020-2021/ mentioned that the estimate will be only 6500 visa for 189 in 2020-2021 (I am not sure how it came up with the number but I saw another article mentioning a similar number). And it seems that this 6500 quota will be prioritised for onshore applicants.

I personally have been waiting for my offshore 189 visa grant for ~18 months (Software Engineer). I am pondering on the following questions and hope to hear your thoughts:

  1. Will it be faster to apply for ​Global Talent Visa (GTI) Program which seems to be the new priority in 2020-2021(instead of hopelessly waiting for the uncertain 189 visa grant)? Honestly I am not sure if the GTI program is more certain, but I am thinking about having a plan B.

  2. Is it fine to apply for another visa (while waiting for 189)? Importantly, will applying for another visa potentially negatively impact or further delay the 189 visa grant?

Appreciate the initiative ! I read the write up of the petition. Can you change it a bit so that it doesn’t just talk about applicants. Instead we can make it an appeal for people outside the applicant’s group. The reason for the ask is, the petition will find traction and will be picked up in the parliament only if it gets close to around 10k signatures and we don’t have those many numbers with us even if we include the families of the applicants. So lets make it as an appeal to outsiders to look at our plight and start signing it. That way it can grab more eyeballs.

The petition says that it can be signed only by citizens and residents but in fact it can be signed by anyone. once you click the checkbox there is no verification to check if you are onshore or offshore, so don’t just refrain from signing it or forwarding it to based on that condition.

The current backlog for this visa is 5 K and around 3 K are onshore applicants.

The fact that onshore applicants are prioritised doesn’t mean anybody located overseas will get their grants. Some people from overseas in the priority occupations list just said few days ago they have been contacted or got their grants.

The issue is how they will use this ceiling and this is why we are working on making sure old applications, pre-covid ones, are assessed and decided as they don’t seem to follow a chronological order for applications to be picked up and assessed. We can expect priority list occupations will jump any other regardless their age, but shouldn’t happen for the ones outside the priority list.

The petition is for applicants only. It’s mentioned there that some primary applicants are separated from their secondary applicants stranded offshore. This is the issue and there is no need to add anything else.

I have read stories of this kind of petitions for a couple only. This one is for a bunch of affected people as refers to different visa types for the skilled stream. We need to try to reach out some applicants for those visa types to help out collecting signatures.

If many more people can sing. It would be greatly appreciated whoever can do it.

Will the DHA refund the application fee as they are not able to take any decision?

Only for the visas specified in the budget.

Temporary visas are some of them.

You shouldn’t sign the petition if you don’t meet that criteria, as invalid signatures can get the whole thing thrown out. Don’t ruin it for those who can legitimately put their name to it out of self-interest.

There is also a backlog of about 8,000 NZ stream applications, which fall into this same stream. In theory they could allocate zero visas to offshore applicants in the skilled stream - thought I don’t think this is the plan.

You can apply for as many visas as you want simultaneously, they’re all treated as separate applications. However, you must withdraw any applications you have in progress if you get a grant, as any other substantive visa overwrites your previous one and you can lose one visa to accidentally get a worse one.

That’s why chronological order is important as these visas are capped. This is the most honest way to make a filter for the cap.

There is data in the disclosure log showing backlog of 1 k in the range of 12 to 18 months and so on, meaning this have been brought forward from previous financial year. This is way would make more sense.

You need to ask your friends who meet this criteria. This is why is not that easy to increase the number of signatures.
